The Inner Badger Talks To Gary
I am not a lawyer, but here is some case law for you: A case I didn't mention in the Video, where Yoko Ono sued Ben Stein and the producers of "Expelled" over Fair Use, AND LOST. www.uniquetracks.com www.wired.com Denial of Preliminary Injunction: cyberlaw.stanford.edu A full lawsuit itself was never filed. Now on to what I was talking about in the video: en.wikipedia.org (complaint - which falls under trademark rather than the DMCA, but the way you present your case is more about the value of your image rather than Intellectual Property, no matter how you choose to see it) news.findlaw.com Other reports on the case: dir.salon.com www.firstamendmentcenter.org www.schwimmerlegal.com blogcritics.org What you are trying to do is more applicable to trademark than Intellectual Property (since you claim that your image is being abused), and not only have you not said that your face has been registered as a trademark, satire and parody still trump that claim as long as there is not malicious conduct that materially devalues your "brand." Seriously, if inflicting malicious humor through the alteration of pictures was a federal crime (as you seem to think it is), the Internet would have been shut down long ago. How you or I feel about it doesn't mean a damn thing; it's up to the judge to interpret the law. Even if you've got a few million to throw into this case, I doubt you'll get treated any better than Fox was.
